Fastmail Brand Guidelines

General terms

  1. Fastmail permits its customers, API developers, partners and the media (“you“) to use its name, trademarks, logos, web pages, screenshots and other brand features (the Fastmail “brand features,” “Marks” or “Logos“) only in limited circumstances and as specified in these guidelines. By using the Fastmail Marks, you agree to adhere to these guidelines including the “Use Requirements and Terms” below. If you have a separate agreement with Fastmail that addresses use of the Fastmail brand, that agreement shall govern your use of the Fastmail Marks.
  2. Subject to any separate agreement between you and Fastmail, our intellectual property rights and the terms of these guidelines, we grant you a limited, revocable, non-transferable and non-exclusive licence to use the Fastmail brand features, Marks and Logos for any purpose approved by us. For example, if you are deemed to be a developer under our API Terms[link] and API Developer Policy[link], the approved purpose for using the Fastmail brand features, Marks and Logos is the purpose of developing a Client Application (as defined in the API Terms and API Developer Policy).
  3. The Fastmail Marks include the Fastmail name and logo, Topicbox name and logo, Pobox name and logo, Listbox name and logo, and any word, phrase, image or other designation that identifies the source or origin of any Fastmail products.

Trademark

  1. “Fastmail” text usage guidelines
    1. The company name is “Fastmail Pty Ltd.”
    2. Do
      1. You are entitled to say that your application is integrated with Fastmail or that you are a Fastmail Platform Partner if you have a client registration key with us.
    3. Do not
      1. Don’t use the Fastmail Marks in a way that suggests a common, descriptive or generic meaning.
      2. Don’t register a domain containing the word “fastmail” or any variation thereof. Deliberate misspellings and transliterations are also not permitted.
      3. Do not apply for a trademark that includes the word “fastmail,” our logo, or any other words or marks similar to our own.
      4. Do not use “Fastmail” or our other trademarks in connection with advertising (search engine or otherwise) without explicit approval from Fastmail.
      5. Do not use the Fastmail brand features or any other confusingly similar words or marks on any apparel, toy, product or other merchandise.
    4. Marking
      1. For usage only within the U.S., use the ® symbol on use of the Fastmail logo and the words “Topicbox” “Pobox” and “Listbox” (“US Registered Marks”), and say “[insert name of relevant mark] is a registered trademark and service mark of Fastmail Pty Ltd” at the bottom of the page on which the relevant US Registered Mark first appears. For example, if you are using the Fastmail logo, you will need to include the registered ® symbol next to the logo and state “The Fastmail logo is a registered trademark and service mark of Fastmail Pty Ltd.”
      2. For usage only within Australia, use the ® symbol on use of the words “Fastmail”, “Topicbox” and “Pobox” (“AU Registered Marks”) and say “[insert name of relevant mark] is a registered trademark of Fastmail Pty Ltd” at the bottom of the page on which the relevant AU Registered Mark first appears. For example, if you are using the Fastmail word mark, you will need to include the registered ® symbol next to the word (Fastmail ®) and state “Fastmail is a registered trade mark of Fastmail Pty Ltd.”
      3. For use of the US Registered Marks in countries outside the US or use of the AU Registered Marks in countries outside Australia, do not use the ® symbol. Instead say “[insert relevant mark] is a trademark and service mark of Fastmail Pty Ltd” at the bottom of the page on which the relevant mark first appears. For example, for use of the word “Fastmail” in the US, do not use the ® symbol. Instead say “Fastmail is a trademark and service mark of Fastmail Pty Ltd” at the bottom of the page on which the Fastmail work mark first appears.
      4. On all marketing materials, include “Copyright Fastmail Pty Ltd.” marking at bottom, for all marketing materials. Font size cannot be smaller than 7 pts.
    5. Logo use guidelines

      2. Do not
        1. Don’t modify the Marks or use them in a confusing way, including suggesting sponsorship or endorsement by Fastmail, or in a way that confuses Fastmail with another brand (including your own).
        2. Don’t use any Logos or similar imagery to represent Fastmail other than the examples we have provided.
        3. Don’t overprint or obstruct any part of the Logo(s).
        4. Don’t add special effects to the Logo(s), including animation.
        5. Don’t use old versions or any other Marks or Logos to represent our brand.
        6. Don’t distribute or otherwise make available our Logos, Marks or brand features.
        7. Don’t crop the Logo(s).
        8. Don’t outline the logotype.
        9. Don’t rotate or distort any part or the whole of the Logo.
        10. Don’t use drop shadows or any other effects.
        11. Don’t re-create the marks using any other typeface.
        12. Don’t change the transparency of the Logo.
        13. Don’t shuffle around the colours of the Logo.
        14. Don’t use different colours for the Logo.
        15. Don’t change the size or orientation of the Logo and wordmark in relation to each other.
        16. No disparaging or objectionable use is permitted.
  2. Screenshots
    1. Screenshots of the Fastmail software and website are permitted for instructive, educational or illustrative purposes.
    2. Don’t include screenshots in your product user interface.
    3. Don’t use screenshots that contain third-party content without the permission of the third party.
    4. Don’t use screenshots that contain any personally identifiable information.

Use Requirements and Terms

  1. Any use of Fastmail brand features must conform to these guidelines.
  2. These guidelines may be modified at any time. Use of the Fastmail brand features constitutes consent to any modifications to these guidelines.
  3. Fastmail has sole discretion in determining if use of the brand features violates these guidelines.
  4. Termination: Fastmail may ask that you stop using the brand features at any time. In the event of termination, use of brand features must stop within a reasonable period from the date of the request, and in all cases no more than 7 days from the date of the request.
  5. Reservation of Rights: Fastmail is the owner of and has sole right, title and interest in the Marks and reserves all rights save the limited license granted here. Use of the Marks pursuant to this license shall not be construed as limiting the rights of Fastmail in the Marks.
  6. FASTMAIL DISCLAIMS ANY WARRANTIES THAT MAY BE EXPRESS OR IMPLIED BY LAW REGARDING THE FASTMAIL MARKS (TO THE EXTENT PERMITTED BY LAW), INCLUDING WARRANTIES AGAINST INFRINGEMENT.
